Terms & Conditions
All orders are subject to the following Conditions of Sale, which can only be altered with the written agreement of C&M Kitchen Engineering Ltd.
We reserve the right to increase prices between quotations & delivery, to the extent that they have been affected by increased material, labour transport & other costs & in respect of any increases imposed by our suppliers. Where possible & practical we will seek customer’s approval for said increases before commencement of works.
Prices quoted do not include Value Added Tax. This will be charged at the appropriate percentage at the date of Invoice.
Prices quoted on our webpages do not include for delivery although most orders to UK Mainland over the value of £200.00 net are free.
Delivery dates quoted are given in good faith, but we cannot accept responsibility for failure to comply nor for any loss or expense arising there from.
All orders, instructions or alterations should be confirmed in writing, failing which our acknowledgement will constitute proof of order.
Orders cannot be cancelled except with our consent & on terms, which will indemnify the sellers against costs or losses.
All goods and/or services are due for payment 30 days from the Invoice date unless otherwise stated or pre-arranged in writing.
All Contract orders should be paid during progress of the work at a rate of 90 percent of the value of the materials on site fixed or unfixed, such payments to be made within fourteen days of application. The balance will be paid within 30 days from date of Invoice.
Overdue accounts are subject to interest (and possibly Debt Recovery Costs) under the ‘Late Payments Legislation’ Act.
We shall despatch goods to customers who do not have an account with us only when we have received payment against a pro-forma Invoice.
All drawings remain the property of C&M Kitchen Engineering Ltd & must not be used in whole or part without our written consent.
Either fixed or unfixed shall remain our property until paid for in full & we reserve the right to uplift these & claim for damages if our conditions of payment have not been complied with. Loss of or damage to materials after delivery to site is the responsibility of the purchaser.
Any warranty given by the manufacturer will be transferred to the customer & no other warranty will be given in respect of such equipment or parts.
DAMAGE IN TRANSIT
Goods or parts damaged in transit will be replaced free of charge provided that the customer notifies us within 48 hours of receipt. Damaged goods or parts should be returned to us within fourteen days from date of receipt. In the case of damage to postal items notification should be made to the Postal Authorities within three days of receiving the parcel.
LOSS IN TRANSIT
In the event of non-arrival or shortages of goods, no claim will be entertained unless we are notified in writing within seven days of the despatch date shown on your Advice Note or Invoice. Non-delivery of postal items must be notified in writing, and to the Postal Authorities, within three days if receiving the parcel.
RETURN OF GOODS
Goods will not be accepted for return without our prior consent. Full credit for goods returned will only be allowed when the full responsibility is admitted by C&M Kitchen Engineering Ltd for faulty merchandise or delivery of the wrong quantity or type of goods. In all other cases goods will not be accepted for return except on terms, which will indemnify the sellers against loss.
